Everything you need to know about...

Please take a good read through the single parts that are important for your project. When you proceed to buy one of my products or a commission, you agree to these "Terms of Service" and  "Terms of Usage" automatically and without further notice.

A violation of my terms will be met with full legal force.

Commissions:

What classifies as commission:

Basically, anything that I only draw - because you asked me to, specifically and personally, as a paid job. That may vary from characters, creatures, to maps, items, backgrounds etc. 

My Ai Policy

Since this is a matter of our time, I will make it clear for once and for all.

You are not allowed to use my artwork, my work-in-progress-screenshots, my videos, my clips, my gifs, my stickers, my finished products, my first sketch or -anything- that I produce from start to finish and beyond, for and with any Ai. No matter if it is text, picture, video or anything else. 

My works are mine, my concepts are mine, and they are not free to get used in any way shape or form - especially not in context with any ai system.

Will I get notice of someone ripping of my work, my style or my concepts, I will take the full range of legal actions.

The rights of usage for a commissioned work: 

To make things short, -

  1. As owner, you can:

    • - use it for non-commercial projects

    • - use it for advertisement

    • - claim the shown characters/items/creatures/etc if they are yours beforehand. I will put your name or your link to a profile below the artworks.

  2. As owner, you cannot automatically:

    • - use it for commercial usage, you need to get my approval in the contract, before the purchase is completed! F.e T-Shirts, Tattoos for others, prints, books, etc.

    • - resell the artwork, if it is a digital artwork. If it is a traditional artwork, you may resell the original. Copies are not allowed.

  3. As owner, you cannot:

    • - claim the artwork to be done by you.

    • - design-it-for-me commissions also exclude you from claiming this would be your design solely.

Things I draw and things I do not draw:

First - I am always and at every point in the position to decline your commission wish, without any notice about the reasons.

What I do draw:

- Creatures

- Characters

- Maps

- Items

- Concept Works

- Architectural Works

- Scene Arts

- Fantasy, Sci-Fi, Horror, Slice-of-Life

What I do not draw:

- Fetish, heavy NSFW, kinks, gore and splatter

- anything that is discriminating against a person, or a community in any way, shape or form.

Ordering a commission: - Summary of the Process -

The work path:

- Request for slot via DM/-Email

- Commission talk

- Invoice sent by me

- Invoice paid by you fully or payment plan

- I start working on your commission always at the beginning of the next month, unless I say otherwise.

- Work-in-progress pictures get sent

- Up to 2 major changes during sketch phase

- Work, work, work, work, work.

- Last approval by you.

- After the payment plan is completed (in case you have chosen none) I will send you the max. size file without big watermark such as the DeviantArt watermark.

 

Ordering a commission: - The Process in detail -

You have to get in contact with me beforehand. In case you just send in money, I have the right to transfer it back to you and decline the commission. A request has to be made before, not matter what. I will then speak with you about the size of the commission, including all information such as number of characters, character details, setting, and so on and so forth.

You have to provide me legit references of the characters/items/etc. in order to get a) spotlight commission, b) scene art commission, c) battle token commission, etc. If you cannot provide legit references of your characters, this will fall into the "design it for me" sector. I will not create a character from scratch, if you want me to draw a scene art. If we agreed on the commission fix points, I will send you an invoice over PayPal, which has to be paid according to our agreement.

I can do payment plans, but I am not obligated to it, and I have to agree on said plan, during our commission conversation(s). The commission has to be paid fully before I start working. Is the commission paid, it gets the active slot in my commission queue, and you will find work-in-progress pictures in your chat-box. - I will keep the right to post work-in-progress pictures also on my social medias and discord. If you don't want this to happen, you can tell me beforehand. Some things shall remain a surprise, sometimes.

You can get up to 2 major changes, during sketch phase - and lately during outline phase. When I pass the outline phase, every major change will come with an extra fee. I will then continue to work on your art piece, sending you wips during every phase of my work.

After sending you the finished work - after the payment plan is concluded - it needs your final approval. If everything is set good, I will then send you the big sized file and upload it with copyright watermark to my social medias.

Refunds:

Refunds will be sent via bank transfer. 

As mentioned above, when you order a commission, I will schedule it to the next 1st of the next calendar month.

To get a refund, you must be in a certain timeframe. This is a service of mine, and not a product. When you pay a commission, you are paying my rent f.e. Giving refunds on this end can turn into a very troublesome situation and with the experience of people trying to scam me, or having other bad intentions, I was forced to make a clear refund policy, that you can find below. I am sorry that this affects everyone out there, but I have no doubts that you will understand me in this regard.

 

Full refund - you cancel your commission 2 weeks before the next calendar month starts at the 1st.

Half refund - you cancel your commission 1 week before the next calendar month starts at the 1st.
30% Refund - you cancel at the beginning of the next calendar month, between 1st to 3rd.

After the 3rd of the month after you paid your commission, you are not getting a refund anymore. 

In the past, I used to make refunds in connection to the time I have already worked on said commission, yet stranded with a few commissioners who told me halfway in, that they didn't want it anymore.

Upload policy:

  1. As commissioner, you can:

    • - Upload your work to any website - as long as you link back to the original file in my deviantArt gallery and make clear, that it was made by me.

    • - Use the artwork as avatar, banner or similar, on apps like Discord

    • - Ask me to take the artwork down, in case problems appeared with the characters shown. If you are picking a fight with me, and there is no understandable reason for me to take it down, I will keep the right to make a single target decision here, based on my right as an artist.

  2. As commissioner, you cannot automatically:

    • - Upload the artwork to a store, sell items with the artwork on it - or the artwork itself - without getting my written permission before.

  3. As commissioner, you cannot:

    • - Claim the artwork to be made by you. Giving credit under the artwork is common and needed.

INZENTIA / [INZ]:

I am working with partial license, when it comes to my INZENTIA / INZ related works/characters/items/maps/etc. This happens, for example in the context of the "we-go-on-a-hunt"-supporter-raffle and the "community commissions" that happened already in the past.  If you commission an artwork, that shows a design that was published under the title of INZ, then -
 

  1. That allows me to:

    • - Show the artwork in project context

    • - Include the plot / concept into stories/canon

  2. That does not automatically allow me to:

    • - Include them into subprojects, like Neonmob (Neonmob is down now, but its an example nonetheless)

    • - Include them into commercial projects, f.e a comic book. For these instances stated above, I will speak with you about the commercial usage of the final artwork and it needs your approval.

  3. This does not allow me to:

  • - Claim the artwork to be only mine, showing only my characters, etc. You will always be stated as commissioner of the artwork - and owner of the adoptable design/character that can be seen.

COMMERCIAL ASPECTS

Commercial Aspects:

To hold things short - anything you want to sell, that has anything to do with my works, concepts or IPs, needs to be specified, written down in a contract that I agreed on and hand signed by me.

If you would like to send me a commercial request, please ensure you have the following answers already at hand:

- What specific product type do you want to sell?

- Where do you want to sell them?

- How many of them do you plan to print/create?

- Over what time period do you want to sell them?

- How many works of mine do you want to include?

- What IP (intellectual property) will these artworks belong to? (f.e Game of Thrones is an IP)

The price will be calculated by the standard price of the work you want to be done by me + a fee for a timely restricted licensing + a fee for the printed/created products, based on their number.

Since I think package deals can be a great opportunity and because I think your projects deserve to get a tailored-to-fit-perfect deal, I am not making any pre-set-up prices here.

TTRPG Assets / Adoptables

What is an adoptable/TTRPG asset?

An "adoptable/ttrpg asset" is a design, f.e for a character/creature/item that I have created without anyone paying me for it, and which I decided to put online for instant-buy on my shop or auction.

Using any of my designs/assets:

 

- You are allowed to show my works on Stream, while giving proper and clear credit. 

- You are allowed to show (!) my works in a non-commercial project.

 

- You must credit me wherever you use any of my assets and works.

- You must inform me about any plan of using my works commercially. 

- You must inform me about uploading my work onto your project plattform.

- You are not allowed to manipulate my works.

- You are not allowed to replicate my works.

- You are not allowed to print my works onto products.

- You are not allowed to sell my works or products with my works on them.

- You are not allowed to use my concepts/iP.

- You are not allowed to use my works or concepts to feed/train an Ai.
